01 — Acceptance
Lumière Noire is a trade name of HD Holdings and Ventures LLC, an Indiana limited liability company located at 329 Middle St, Newburgh, IN 47630. References to "LUMIÈRE NOIRE," "we," "us," or "our" in these Terms refer to HD Holdings and Ventures LLC operating under that trade name.
By using shoplumierenoire.com or purchasing The Halo, you agree to these Terms. If you do not agree, do not use the site or purchase.
02 — The Object
The Halo is a personal-care LED light object. It is not a medical device. It is not intended to diagnose, treat, cure, or prevent any disease or skin condition. Individual experiences vary.
03 — Orders and Shipping
All orders are subject to acceptance and availability. The Halo ships from our manufacturing partner overseas, with a delivery window of fourteen to twenty-eight days from order. International customers may be responsible for local import duties or taxes.
04 — Returns
Unused units, in original packaging, may be returned within thirty days of delivery. Contact team@shoplumierenoire.com before returning. Refunds are issued to the original method of payment within ten business days of receipt.
05 — Warranty
See the Warranty page for the full warranty document. The warranty stated there is the sole warranty offered, to the fullest extent permitted by law.
06 — Intellectual Property
All content on shoplumierenoire.com, including text, photography, layout, and the LUMIÈRE NOIRE wordmark, is the property of LUMIÈRE NOIRE and may not be reproduced without written permission.
07 — Acceptable Use
Do not use the site to violate any law, infringe any right of another, or interfere with the operation of the site.
08 — Limitation of Liability
To the fullest extent permitted by law, LUMIÈRE NOIRE's total liability arising from or related to The Halo or this site is limited to the amount paid for the unit in question. LUMIÈRE NOIRE is not liable for indirect, incidental, consequential, or punitive damages.
09 — Governing Law
These Terms are governed by the laws of the State of Indiana, United States, without regard to conflict of laws principles. The exclusive forum for any dispute not subject to arbitration is the state and federal courts located in Vanderburgh County, Indiana.
10 — Arbitration and Class Action Waiver
Any dispute arising from or related to these Terms, the site, or The Halo will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You and LUMIÈRE NOIRE waive any right to participate in a class, collective, or representative action. You may opt out of this arbitration agreement by writing to team@shoplumierenoire.com within thirty days of your first purchase, stating your intent to opt out and including your order number.
11 — Changes
LUMIÈRE NOIRE may update these Terms. The current version is the version posted on this page. Continued use of the site after changes constitutes acceptance.
